FinCEN and banking agencies clarify SAR confidentiality in customer communications
On September 2, 2026: FinCEN and federal banking regulators issued a joint statement clarifying that SAR confidentiality does not prevent banks from discussing underlying potentially fraudulent transactions, suspicious activity or account closures with customers. The statement does not change existing BSA requirements or create new supervisory expectations. It is tracked as a regulation move because FinCEN published the primary source.
